These Terms and Conditions govern your use of the Silverpath website at silverpath.club and your engagement with any Silverpath service. By using the website or engaging a service, you accept these terms. Please read them carefully.
1. Definitions
- "We / Us / Our / Silverpath" — Silverpath, operating from 33 Thanon Surawong, Si Phum, Mueang Chiang Mai, Chiang Mai 50200, Thailand.
- "Service" — any of the information services offered by Silverpath, including Planning-Ahead Information Evenings, the Pension Paperwork Setup Service, and Workforce Retirement Resource Consulting.
- "User / You" — any individual who accesses the website or engages a Silverpath service.
- "Content" — all materials published on the Silverpath website or provided during sessions and service engagements, including text, checklists, handbooks, and process maps.
- "Agreement" — these Terms and Conditions, together with any written service scope agreed with you.
2. Acceptance of Terms
By submitting an enquiry form, registering for a session, or engaging a Silverpath service, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into this Agreement
- You accept these terms in full
If you are engaging on behalf of an organisation, you confirm that you are authorised to do so.
3. Nature of Our Services
Silverpath provides educational and organisational information services only. Our services do not constitute:
- Financial advice
- Investment advice
- Legal advice
- Regulated advice of any kind
Nothing in our sessions, documents, checklists, or handbooks should be understood as a personal recommendation regarding any financial product, pension scheme, or investment decision. Users are encouraged to seek advice from a qualified, licensed professional for matters relating to their individual circumstances.
Services are primarily delivered in Chiang Mai, Thailand. Remote delivery may be available for certain services; this will be confirmed during the enquiry process.
4. Session Registration and Attendance
- Session places are confirmed upon receipt of payment
- Registered attendees will receive joining details by email at least 48 hours before the session
- Sessions are conducted in English
- Silverpath reserves the right to reschedule or cancel a session; in such cases, a full refund or an alternative date will be offered
- Session content is for personal, non-commercial use unless otherwise agreed in writing
5. Payment Terms
All fees are quoted in Thai Baht (THB) before applicable VAT.
- Planning-Ahead Information Evenings: ฿3,600 per person, payable in advance to confirm registration
- Pension Paperwork Setup Service: ฿11,100, payable in advance of the first session
- B2B Workforce Retirement Resource Consulting: From ฿35,000 per project; payment schedule agreed in the written scope of work
Payment may be made by bank transfer in Thai Baht. Payment details will be provided upon booking confirmation.
Refunds
- Cancellation more than 7 days before a session: full refund
- Cancellation 3–7 days before a session: 50% refund
- Cancellation fewer than 3 days before a session: no refund; session credit may be offered at our discretion
- For the Paperwork Setup Service: if cancelled before the first meeting, a full refund is available; after the first meeting, a partial refund proportional to work not yet completed may be considered
- For B2B projects: refund terms are specified in the written scope of work
6. User Responsibilities
When using the Silverpath website or engaging our services, you agree to:
- Provide accurate information in forms and during engagements
- Use session and service materials for personal or internal organisational purposes only, not for redistribution or resale
- Not misrepresent the nature of Silverpath's services (for example, representing our information as professional financial advice)
- Not use the website in a way that could damage, disable, or impair it
7. Intellectual Property
All content produced by Silverpath — including session curricula, handbooks, checklists, process maps, and website text — is the intellectual property of Silverpath unless otherwise stated in a written agreement.
You are granted a limited, non-exclusive, non-transferable licence to use materials received through our services for your own personal or internal organisational purposes. You may not copy, distribute, publish, or commercially exploit those materials without our prior written consent.
For B2B projects, ownership of deliverables is addressed in the written scope of work for that project.
8. Disclaimers
Silverpath's services are provided on a best-efforts basis. We do not make any representation or warranty that:
- Information provided in sessions or documents is complete, current, or suitable for your specific circumstances
- Engaging our services will produce any particular outcome for you
- The website will be available without interruption or error
Content is updated periodically against publicly available sources, but retirement regulations and administrative processes may change. Users are responsible for verifying information with the appropriate authorities or licensed professionals.
9. Limitation of Liability
To the fullest extent permitted under Thai law, Silverpath's total liability to you for any claim arising from these terms or our services shall not exceed the fee paid by you for the specific service to which the claim relates.
We are not liable for any indirect, consequential, or special loss, including loss of income, arising from your use of our services or the information provided.
Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence.
10. Indemnification
You agree to indemnify Silverpath against any claims, costs, or liabilities arising from your misuse of our services or materials, or from any breach of these terms by you.
11. Termination
Either party may withdraw from an engagement by giving reasonable written notice. Where a service has already been partially delivered, fees for work completed will be retained and a proportional refund for undelivered portions may be offered.
Silverpath reserves the right to decline or terminate an engagement if a user's conduct is disruptive or inconsistent with the educational nature of our services.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these terms or from an engagement with Silverpath will first be addressed through good-faith discussion. If a resolution cannot be reached informally within 30 days, the matter will be referred to the courts with jurisdiction in Chiang Mai, Thailand.
13. General Provisions
- Entire agreement: These terms, together with any written scope of work, constitute the full agreement between us.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: Failure to enforce a provision does not constitute a waiver of the right to enforce it in the future.
- Assignment: You may not assign your rights under these terms without our written consent.
14. Changes to These Terms
We may update these terms from time to time. The updated version will be published on this page with a revised "Last Updated" date. Material changes will be notified by a notice on the website. Continued use of the website or our services after the change constitutes acceptance of the updated terms.
